1. About FundFair

FundFair is an online platform that allows creators to receive direct financial support from their fans and supporters. We provide tools for creators to set up a public page, share content, and receive one-time donations. We do not employ creators, manage their content businesses, or guarantee any level of earnings.

2. Eligibility

To use FundFair you must:

• Be at least 18 years old
• Be capable of forming a binding contract
• Not be prohibited from using the service under any applicable law
• Have a valid email address

By creating an account, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the security of your account and password. FundFair cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

4. Creator Accounts

Creators are individuals or entities who set up a public page on FundFair to receive support from fans. As a creator, you agree to:

• Provide accurate information about yourself and your content
• Only post content that you have the right to share
• Not post content that is illegal, harmful, abusive, defamatory, or violates the rights of others
• Comply with all applicable laws, including tax laws in your jurisdiction
• Connect a valid Stripe account to receive payouts

You are solely responsible for paying any applicable taxes on income received through FundFair. FundFair does not provide tax advice.

5. Payments and Fees

All payments on FundFair are processed by Stripe, Inc. By using payment features, you also agree to Stripe's terms of service.

When a supporter makes a donation:

• The creator receives 100% of the listed donation amount
• A small platform fee and payment processing fee are added to the supporter's total at checkout
• Fees are displayed transparently before any payment is made

FundFair reserves the right to change its fee structure with reasonable notice to users.

6. Prohibited Content and Conduct

You may not use FundFair to:

• Post or promote illegal content of any kind
• Harass, threaten, or abuse other users
• Impersonate another person or entity
• Post sexually explicit, violent, or otherwise harmful content
• Engage in fraud or deceptive practices
• Violate any applicable law or regulation
• Use automated means to access the platform without permission
• Attempt to gain unauthorised access to any part of the platform

FundFair reserves the right to remove content and suspend or terminate accounts that violate these terms at our sole discretion.

7. Intellectual Property

You retain ownership of all content you post on FundFair. By posting content, you grant FundFair a non-exclusive, worldwide, royalty-free licence to display and distribute that content solely for the purpose of operating and promoting the platform.

FundFair's name, logo, and platform design are owned by FundFair and may not be used without permission.

8. Disclaimers

FundFair is provided "as is" without warranties of any kind. We do not guarantee that the platform will be available at all times, error-free, or free from viruses or other harmful components. We do not guarantee that any creator will achieve any particular level of earnings.

9. Limitation of Liability

To the maximum extent permitted by law, FundFair shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim arising from these terms or your use of the platform shall not exceed the greater of $100 or the total fees paid by you to FundFair in the twelve months preceding the claim.

10. Termination

You may close your account at any time by contacting us. FundFair may suspend or terminate your account at any time for any reason, including violation of these terms. Upon termination, your public page will be removed. Any pending payouts will be processed according to Stripe's standard timeline.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes by email or by posting a notice on the platform. Continued use of FundFair after changes take effect constitutes your acceptance of the updated terms.

12. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through binding arbitration or in the courts of competent jurisdiction.
